By subscribing to, purchasing and/or using any of our anonymous services, you are agreeing that you have read, understand and are in compliance with our terms of service agreement as show below. THIS AGREEMENT is made by and between ForHost2U.com (hereinafter " ForHost2U " or " ForHost2U.com") and Any Client (hereinafter "Client"). This agreement shall be referred to as the Terms of Service Agreement ("Agreement").

NOW THEREFORE THIS AGREEMENT WITNESSES THAT in consideration of the mutual covenants and agreements herein contained and subject to the term and conditions hereafter set out, the Client agrees to the following:

This Services Agreement contains the complete terms and conditions which govern your subscription of Anonymous Hosting and/or Anonymous Domain Registration. By clicking on the "Submit" button, you acknowledge that you have read the Anonymous Services Agreement, and you agree to its terms of service.
Our service is considered to be anonymous. We do not request your Name, Address, Phone Number, Fax Number or any other personal or business information except your e-mail address. You can choose to provide a web based e-mail for maximum anonymity. If you volunteer any of the above information to ForHost2U.com, we will document it in our records. If we receive a legal request from an authority of the United States, we are required by law to turn over any information we have on record. We never ask for any of your personal information, therefore we can never give it out. Therefore, disclose at your own risk.

:: Service Specific Agreements ::
Domains that you purchase through ForHost2U.com are registered and owned by the you. Under this agreement you are granted all the rights of domain management. You may buy, sell and manage your domains. You may also redirect your domains to any server and specify DNS for your domains.

If you neglect to pay for domain services, we reserve the right to cancel this agreement and repossess the rights granted to you over the domain(s) in question. We reserve the right to terminate your hosting account without notice for any violation of our agreement or any apparent or implied violation of the law.

Clients may occupy only the amount of disk space on ForHost2U.com servers and utilize no more than the network bandwidth which is allotted by ForHost2U.com. However, account upgrades are available. Client may be charged for over-utilization of either disk space or network bandwidth. Client shall not use our services for chain letters, junk mail, spamming or any use of distribution lists to any person who has not given specific permission to be included in such a process. Client also shall not engage in any unsolicited email practices on or through our servers.

ForHost2U.com, in its sole discretion, may immediately terminate this Agreement if Client engages in any of the foregoing. :: Refund Policy ::
Our refund policy (aka. Money Back Guarantee) is published here. When you agree to our terms & conditions, you also agree to our refund policy as well.

  :: General Fraud and Scam Sites ::
If your site is a scam (like carder sites, fake auction sites, fake exchange sites etc) and we see this after visiting it, you will be automatically terminated without a refund and without and prior warning. We reserve the right to eliminate all fraudulent websites, databases and mail from our servers at our discretion. We feel we have enough experience to know the difference and will act without hesitation. If you plan on running a scam or fraud on our servers we ask you to look elsewhere as you risk getting deleted without any refund.

:: Short List of Acceptable Sites ::
- Personal and Business sites
- News, info-depositories and medical sites
- Underground sites including: news, research, communications and knowledge, but not including sites that promote racism, violence or warez. If it says hackerz has passwordz, gamez, warez or any of the "z" stuff we won't host it.

:: Short List of Sites We DO NOT Accept ::
- Adult sites
- Auction sites
- Carding sites or Forums
- Gambling sites
- Phising & Fraudulent sites
- Hate sites
- Racism, Violence or Warez sites
- Sites distributing hacking tools, data, products or services
- Proxy scripts
- Sites selling unlicensed software
- Unlicensed Banking sites
- Child pornography of any sort
- Sites selling class 3 and above narcotics (including recreational drugs)

:: What we do after you violate our AUP ::
Read this section carefully to know what happens after you violate the AUP.

We'll check your website contents after 10 days from the day of your purchase. This period of 10 days will give you enough time to create & upload your initial website. During our check, if we find that you are violating any of our terms, we'll immediately suspend your site. After suspension, you'll have 7 days to contact us & resolve this situation with us. If the matter is not resolved (or remains unresolved), we'll permanently TERMINATE your hosting account. NO refunds & backups will be provided if your account gets terminated due to violating our terms.

If your account gets suspended due to spamming, your account will be permanently TERMINATED within 48 hours without any backup or refunds. To see our zero-spam policy, click here.

:: Billing Over-due Policies ::
We will send you a renewal reminder 5 days before your service expires. Your service will be given a grace period of 2 days. If payment is not received within this grace period, your service will be suspended and not be viewable online. After suspension, if you do not reactivate your service by paying the renewal fees within 7 days from the date of suspension, your site will be permanently deleted from our servers without any backup.

:: No Spamming Allowed ::
Sending unsolicited bulk and/or commercial messages over the Internet is known as "spamming". We have ZERO tolerance about any spam. It is not only harmful because of its negative impact on consumer attitudes toward ForHost2U.com, but also because it can overload ForHost2U.com network and disrupt service to ForHost2U.com clients. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, ForHost2U.com has the discretion to determine from all of the evidence whether the e-mail recipients were from an "opt-in" e-mail list. We do not allow large mass mailings of any sort even if they are opt-in.

So, please make sure that NO spam is sent out to promote your site. It doesn't matter whether the spam is sent out thru our mail server or some other mail server. Because, as soon as your spam gets reported to the SpamCop.net (or any other Spam Monitoring Organization), we will have no choice but to suspend & terminate your account (in fact, we will be forced to do so by our datacenter). Also, make sure that none of your clients/members/referrals send out spam mails either. YOU are always liable for all your clients/members/referrals.

Any kind of exclusive mass mailing scripts and/or email address lists are NOT allowed to be uploaded on the server, even if you do not send out any emails using those scripts. If we find any such files in your account, it will be treated the same as spamming. This is necessary for preventing any potential spam abuse that may happen in future using those scripts.

If your account gets suspended due to spamming, your account will be TERMINATED & deleted from our server within next 2 days without any backups. Your domain will also be suspended until it expires. Also, you'll not be eligible for any refunds if your account gets suspended/terminated due to violation of our terms & conditions.

:: Abuse of Server Resources (a.k.a. Overloading)::
Shared server accounts are limited in use of the amount of server resources. Shared server resource abuse includes any process or service usage that affects normal shared server operation, resources or connectivity, and which causes a server to become overloaded. Shared server resources include CPU and memory usage, number of concurrent processes, number of concurrent port or database connections and total bandwidth. Possible causes of server resource abuse include, but are not limited to, the use of: CGI, Perl, Sendmail, mySQL, MSSQL, PHP, ASP, COLDFUSION, HTTP, SMTP, POP3 and FTP. If server resource abuse is detected, possible actions include, but are not limited to: disabling of the offending script or scripts, disabling of the specific service, disabling of the entire account or account cancellation. If server overload is a result of server resource abuse, these actions will be taken without prior notice or warning.

:: Defamatory or Abusive Language ::
Using ForHost2U.com network as a means to transmit or post defamatory, harassing, abusive, or threatening language.

:: Forging of Headers ::
Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.

:: Illegal or Unauthorized Access to Other Computers or Networks ::
Accessing illegally or without authorization computers, accounts, or networks belonging to another party or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan or other information gathering activity).

:: Background Running Programs ::
Background Daemons in general are prohibited on ForHost2U.com servers, including, but not limited to, IRC bots, Eggdrop, BitchX, XiRCON, Warez sites and any other program that interferes with normal server operation. ForHost2U.com will be the sole arbitor of what consitutes a violation of the above policy.

:: Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities ::
Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing, or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service, or equipment.

:: Facilitating a Violation of this AUP ::
Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mail bombing, denial of service attacks, and piracy of software.

:: Export Control Violations ::
Exporting encryption software over the Internet or otherwise, to points outside the United States that is forbidden by law.

:: Usenet Groups ::
ForHost2U.com reserves the right not to accept postings from newsgroups where we have actual knowledge that the content of the newsgroup violates the AUP.
